Aerticket India – Terms of Service

Welcome to Raviwo Aerticket Alliance India Private Limited (“Aerticket India”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of our websites, apps, APIs, software, platforms, and related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.
These Terms are intended for: (i) B2B users (e.g., travel agencies, distributors, corporate travel managers and their authorized personnel); (ii) suppliers (e.g., airlines/hotels/aggregators where applicable) using our distribution technology; and (iii) visitors.
If you are an agency or corporate using the Services on behalf of end customers, you are responsible for (a) lawful collection and sharing of customer information, (b) obtaining all required permissions/consents, and (c) informing customers of applicable terms and policies.
- Acceptance of Terms
By using the Services, you confirm that you are at least 18 years old, have the legal capacity and corporate authorization to bind your organization (where applicable), and agree to these Terms and all policies referenced herein (including our Privacy Policy). If you do not agree, do not use the Services.
- Account Registration and B2B Access
- Accuracy: You must provide complete, accurate, and current information, and keep it updated. You represent and warrant that all information you supply to us, about yourself, and others, is true and accurate.
- Credentials: Keep log‑ins, OTPs, API keys, and MFA secrets confidential. You are responsible for all activity under your accounts.
- Authorized Users: You must ensure only authorized personnel access your account and comply with these Terms. You remain liable for their actions.
- Verification: We may require KYC/KYB, credit checks, security deposits or guarantees, and may approve/limit/deny access at our discretion.
- Nature of Services
Aerticket India provides travel search, booking, ticketing, and related technology and intermediary services. We do not control or operate airlines, hotels, rail, cruise, car rentals, visa centers, insurers, or other travel suppliers. Supplier terms, fare rules, and policies govern your bookings in addition to these Terms.
- Use of the Platform; License; Prohibited Conduct
- License: Subject to these Terms, we grant you a limited, revocable, non‑exclusive, non‑transferable license to access, view and use the Services for legitimate travel business purposes.
- Prohibited: You will not (a) misuse the Services; (b) engage in fraud, speculative or duplicate reservations, churning or fake/test PNRs; (c) infringe IP rights; (d) introduce malware or scrape/crawl without written consent; (e) interfere with or burden the platform; (f) resell B2B wholesale rates in violation of supplier rules; or (g) bypass booking limits, security, or credit controls (h) Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of other (i) Publish, post, distribute or disseminate any defamatory, infringing, obscene, indecent or unlawful material or information (j) Upload or attach files that contain viruses, corrupted files or any other similar software or programs that may damage the operation of another's computer (k) Upload or attach files that contain software or other material protected by intellectual property laws (or by rights of privacy and publicity) unless the User owns or controls the rights thereto or has received all consents therefor as may be required by law (l) Delete any author attributions, legal notices or proprietary designations or labels in any file that is uploaded (m) Falsify the origin or source of software or other material contained in a file that is uploaded (n) Advertise or offer to sell any goods or services, or conduct or forward surveys, contests or chain letters, or download any file posted by another user of a Forum that the User knows, or reasonably should know, cannot be legally distributed in such manner. You shall not distribute, exchange, modify, sell or transmit anything you copy from this Site, including but not limited to any text, images, audio and video, for any business, commercial or public purpose.
- Monitoring & Enforcement: We may suspend or terminate access, cancel PNRs/tickets, or adjust/correct bookings for suspected abuse, pricing/availability errors, or policy violations.
- Booking Rules; Fares; Availability
- Fare Rules: All bookings are subject to the fare rules, inventory, and conditions set by each airline/hotel/supplier. Many fares are non‑refundable and non‑transferable.
- Dynamic Content: Prices and availability are dynamic and may change until ticketing/confirmation. Obvious errors/misprints may be corrected and affected bookings revised or cancelled with a refund of monies received.
- Ancillaries & Special Requests: Seat, baggage, meals, accessibility or other requests are subject to supplier confirmation and may incur additional charges.
- Payments; Fees; Taxes; Chargebacks
- Payment Methods: We may accept netbanking, cards, UPI/VPA, wallets, credit line, or agency wallets, processed via compliant gateways.
- Card Use & Authorization: If you use a card, you represent that it is legally authorized and will complete all verification steps (3‑D Secure/OTP, issuer verification). You are liable for chargebacks, reversals, or fraud arising from unauthorized or improper use of cards, and must indemnify us and promptly reimburse all related amounts, fees, and penalties.
- Charges & Surcharges: Convenience/payment gateway fees, currency conversion, and bank charges may apply.
- Taxes: You are responsible for applicable taxes (including GST/TCS) and for providing accurate GST details to enable correct invoicing.
- Invoicing & Set‑off: We may set‑off any sums owed to us against credits/refunds due to you.
- Non‑payment: Failure to pay when due may result in suspension, PNR/ticket cancellation, interest, recovery, and adjustment of credit limits.
- Agency Debit Memo (ADM) & GDS/Content Misuse
You are responsible for all ADM/agency debit notes issued by airlines/GDS/suppliers arising from, without limitation: churning, duplicate or speculative bookings, fake/test names, abusing holds/time limits, wrongful reissues, OAL violations, married segment abuse, and other booking policy breaches. All such ADMs, penalties, and pass‑through fees are recoverable from you, including our reasonable administrative costs of handling such ADMs.
- Cancellations, Changes, No‑Shows & Refunds
- Supplier Rules: Cancellations/changes/no‑shows are governed by supplier fare/rate rules and may attract fees or be disallowed.
- Process: Submit change/cancel requests via the platform within the permitted time. For near‑departure cases, contact the airline/supplier directly where required by policy.
- Refunds: Refunds (if any) are processed only after we receive funds from the supplier and will be credited via the original mode or agency wallet, net of applicable charges. Processing timelines vary by supplier. No refunds for partially used/expired services unless permitted by rules.This shall be subject to the refund policy.
- Force Majeure & Disruptions: Reaccommodation, waivers, or credits are subject to supplier policies during disruptions, including weather, strikes, ATC restrictions, pandemics, or government orders.
- Visas, Travel Documents & Compliance
- Your Responsibility: You must ensure that all travelers possess valid passports, visas, transit permissions, health/vaccination certificates, and meet entry/exit requirements.
- No Guarantee: Visa or immigration decisions are at the sole discretion of authorities. We do not influence such decisions and fees are typically non‑refundable once applied.
- Overstay/Non‑compliance: You are liable for penalties, fines, or losses arising from travelers’ non‑compliance with immigration, customs, or airline policies and agree to indemnify us for related claims.
- Intellectual Property
All content, software, trademarks, and materials in the Services are owned by us or our licensors and protected by Intellectual Property laws. You receive no rights except as expressly granted. You shall not copy, modify, reverse engineer, frame, or create derivative works without our written consent. Any feedback you submit may be used by us without restriction.
- Platform Changes & Maintenance
We may modify, suspend, or discontinue any feature, content, or access (including for maintenance or legal/compliance reasons) without liability. We may introduce additional controls, rate limits, and security checks to protect users, suppliers, and our systems.
- Privacy
Your use of the Services is subject to our Privacy Policy (as updated from time to time), which describes how we collect, use, and share information. Please review it carefully.
- Warranties; Disclaimers
The Services and all content are provided on an “as is” and “as available” basis without warranties of any kind. To the maximum extent permitted by law, we disclaim all warranties (express, implied, statutory), including merchantability, fitness for a particular purpose, non‑infringement, accuracy, uninterrupted or error‑free operation, and that defects will be corrected. We do not warrant services offered by third‑party suppliers or that travel to any destination is advisable or risk‑free.
- Limitation of Liability
To the maximum extent permitted by law: (a) we shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages; and (b) our aggregate liability for all claims arising out of or relating to the Services shall not exceed INR 1,000 or the total service fees paid to us for the affected booking(s), whichever is lower. These limits apply regardless of the legal theory and even if a remedy fails of its essential purpose.
- Indemnity
You agree to defend, indemnify, and hold harmless Aerticket India, its affiliates, directors, officers, employees, and agents from and against all claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms or applicable law; (b) your misuse of the Services; (c) inaccuracies in data provided by you; (d) chargebacks or payment disputes; (e) ADM/GDS violations; or (f) claims by travelers or suppliers attributable to your acts/omissions.
- Sanctions, Anti‑Corruption & Export Controls
You represent that neither you nor your directors/UBOs are subject to sanctions or on any restricted lists (e.g., OFAC, UN, EU, UK). You will not use the Services in violation of applicable sanctions, anti‑corruption, anti‑money laundering, or export control laws, and you will notify us promptly of any change in status.
- Term & Termination
We may suspend or terminate access immediately for suspected fraud, non‑payment, legal/regulatory risk, or material breach. You may terminate by closing your accounts and ceasing use, subject to settlement of dues. Clauses that by their nature should survive (e.g., payments, IP, indemnities, limitations of liability, governing law) will survive termination.
- Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Any disputes shall be resolved by arbitration under the Arbitration and Conciliation Act, 1996 (as amended). Seat/Venue: Mumbai, India
Language: English
Tribunal: Sole arbitrator appointed in accordance with the Act or institutional rules agreed by the Parties.
Courts at Mumbai shall have exclusive jurisdiction for interim relief and enforcement.
- Changes to Terms
We may update these Terms at any time. Updated versions will be posted on the Services with an updated “Last Updated” date. Your continued use constitutes acceptance of the updated Terms.
- Miscellaneous
- Severability: If any provision is unenforceable, the remainder remains in effect.
- No Waiver: Our failure to enforce a provision is not a waiver.
- Assignment: You may not assign these Terms without our consent. We may assign to an affiliate or in connection with a reorganization or sale.
- Entire Agreement: These Terms, along with the Privacy Policy, Refund Policy, Disclaimer and booking‑specific rules/supplier terms, constitute the entire agreement with respect to the Services.
- Notices: We may provide notices via email, dashboards, or postings. You must keep your contact details updated.
